Welcome to StopNic. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and StopNic (“we,” “our,” or “us”) governing your use of the StopNic mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
By accessing or using the App, you confirm that you: (a) are at least 18 years old; (b) have the legal capacity to enter into a binding agreement; and (c) agree to comply with these Terms and all applicable laws and regulations. The App is intended for adults only and is not directed to anyone under 18. If you are under 18, you may not use the App.
StopNic is a nicotine cessation support application that provides:
IMPORTANT: StopNic is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is designed as a behavioral support tool and is for informational and motivational purposes only.

You may not create multiple accounts, share your account credentials, or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these Terms.
The 3-day free trial is available with the Annual plan only and is limited to one trial per Apple ID. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid annual subscription at the then-current price.
You may cancel your subscription at any time through your Apple ID Account Settings > Subscriptions. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of the paid period. No partial refunds are issued for unused portions of a billing period.
All purchases are processed by Apple through the App Store. Refunds are handled solely by Apple in accordance with the Apple Media Services Terms and Conditions, and are granted at Apple’s discretion or where required by applicable law. We do not directly process payments and cannot issue refunds ourselves. To request a refund, visit reportaproblem.apple.com or use your Apple ID Account Settings. Content moderation decisions are at our sole discretion and are final. Repeated violations will result in permanent account termination.
All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, educational materials, algorithms, software, and the overall design and compilation thereof, is the exclusive property of StopNic or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not:
You retain ownership of content you create within the App (community posts, notes, reflections, journal entries). By posting content in community features, you grant StopNic a non-exclusive, worldwide, royalty-free, sublicensable license to display, distribute, and reproduce that content within the App for the purpose of operating and improving the service.
You represent and warrant that you own or have the necessary rights to all content you post and that your content does not violate any third-party rights or applicable laws.
If you believe that content on the App infringes your copyright, please send a written notice to legal@stopnic.app containing:
We will respond to valid DMCA notices in accordance with the Digital Millennium Copyright Act and may remove or disable access to the allegedly infringing material.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
You agree to indemnify, defend, and hold harmless StopNic and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit, post, or transmit through the App.
Before filing any formal dispute, you agree to first contact us at legal@stopnic.app and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved through informal negotiation.
If the dispute cannot be resolved informally, you and StopNic agree that any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Wilmington, Delaware (or, at your election, your county of residence). The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND STOPNIC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.
Nothing in this section prevents either party from: (a) seeking injunctive or other equitable relief in court for intellectual property infringement or misappropriation; (b) filing claims in small claims court if the claim qualifies; or (c) pursuing claims that cannot be subject to arbitration under applicable law.
Any claim or cause of action arising out of or related to your use of the App or these Terms must be filed within one (1) year after such claim or cause of action arose. Failure to file within this period constitutes a permanent waiver of such claim.
The following additional terms apply with respect to the Apple App Store:
StopNic shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power failures, internet or telecommunications failures, cyberattacks, or third-party service provider outages.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App with a new “Last Updated” date and, where appropriate, sending a push notification or in-app notice. Your continued use of the App after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may stop using the App at any time. Upon termination:
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Subject to the arbitration clause above, any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in such courts.
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and StopNic regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
The failure of StopNic to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by StopNic.
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.
We may provide notices to you through the App, via push notification, or to the email address associated with your account. You may provide notices to us by emailing legal@stopnic.app. Notices are deemed received upon delivery for electronic communications.
